Terms and Conditions of Service

General

Lingopeel mobile application (“App”) and related services (collectively referred to as the “Service”) are operated by Lingopeel (“Lingopeel,” “us,” or “we”). By accessing or using any part of the Service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service. We may update these Terms from time to time, and if we make significant changes, we will notify you by posting a notice on our App. Changes will be effective after a 7-day notice period or the next time you access or use the Service after such changes, whichever comes first.

PLEASE NOTE: THESE TERMS CONTAIN A MANDATORY ARBITRATION PROVISION THAT REQUIRES DISPUTES TO BE RESOLVED THROUGH ARBITRATION ON AN INDIVIDUAL BASIS, RATHER THAN IN COURT OR THROUGH CLASS ACTIONS.

Description of the Service

The Service allows users to access and use a variety of educational tools, including learning and practicing languages. Lingopeel may, in its sole discretion, update, modify, suspend, or discontinue any aspect of the Service at any time.

Acceptable Use of the Service

You are responsible for your use of the Service, and for any use made using your account. Our goal is to create a positive, useful, and safe user experience. To support this goal, we prohibit certain activities that may be harmful to other users or to us. When using the Service, you must comply with our Community Guidelines.

Registration

When registering for and using the Service, you agree to (i) provide accurate, current, and complete information about yourself as requested by Lingopeel; (ii) maintain the confidentiality of your password and other account security information; and (iii) be fully responsible for all activities that occur under your account and any other actions taken in connection with your account.

Your Representations and Warranties

You represent and warrant to Lingopeel that your access and use of the Service will comply with these Terms and all applicable laws, regulations, and rules of the United States and any other relevant jurisdiction, including those relating to online conduct and acceptable content, as well as those governing the transmission of data or information exported from the United States and the jurisdiction in which you reside.

Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which can be found at https://lingopeel.com/privacypolicy. By using the Service, you consent to the practices described in the Privacy Policy.

In-App Purchases

The App may include the option to purchase subscriptions. If you choose to make an in-app purchase, you agree to pay the applicable fees and taxes. All payments are non-refundable, except as required by applicable law or as otherwise stated in our refund policy. Lingopeel may manage, regulate, control, modify, or eliminate subscriptions at any time, with or without notice.

License

Subject to your compliance with these Terms, Lingopeel grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download and install a copy of the App on a mobile device that you own or control and to run such copy of the App solely for your personal use.

Termination

We may terminate or suspend your account and access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Lingopeel, its affiliates, licensors, or service providers, be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; and (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party.

Disclaimer of Warranties

The Service is provided on an “as-is” and “as available” basis. To the fullest extent permitted by applicable law, Lingopeel disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Lingopeel does not warrant that the Service will be uninterrupted, timely, secure, or error-free.

Governing Law

These Terms shall be governed and construed in accordance with the laws and regulations of the United States and any other relevant jurisdiction, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located in the United States to resolve any dispute or claim arising from these Terms.

Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
